Authorize Director of Public Utilities or designee to sign on behalf of the City ..Body RECOMMENDATION Staff recommends that the City Council approve an amendment to the consultant services agreement with Blair Church & Flynn (BCF) consulting engineers, a California corporation, of Clovis, California, in the amount of $36,900 for professional engineering services for the design of sewer rehabilitation and replacement projects in Glenn, N Street, Tuolumne, Van Ness, Merced, and Thorne Avenues and authorize the Director, or designee, to sign the agreement on behalf of the City. EXECUTIVE SUMMARY The Department of Public Utilities (DPU), Wastewater Management Division has a design services contract in place with BCF of Clovis, California, for the design of sewer rehabilitation and replacement projects in Glenn, N Street, Tuolumne, Van Ness, Merced, and Thorne Avenues in the amount of $182,200. After the design services contract was awarded, DPU identified a need to implement design and scope changes to the project to better coordinate this work with other active projects in the Downtown Area. DPU staff is seeking to amend the contract in the amount of $36,900 with BCF of Clovis, California, to better coordinate the projects. BACKGROUND On November 11, 2013 a contract in the amount of $182,200 was awarded to BCF for the design of sewer rehabilitation and replacement projects in Glenn, N. Street, Tuolumne, Van Ness, Merced, and Thorne Avenues. This project was identified in the 2006 Sewer System Management Plan (SSMP). After the design services contract was awarded, DPU identified a need to implement design and scope changes to the project to better coordinate this work with other active projects in the Downtown Area. The other active projects in the area that require coordination include the Downtown Recycled Water Treatment Facility; Phase I of the Recycled Water Distribution System (which will serve the Downtown Area); the High-Speed Rail Project; and the Fulton Mall Restoration Project. The original design contract for the project as a whole was $182,200. Staff has negotiated the additional scope to the contract for an increase of $36,900 which brings to the total sum of the contract to $219,100. The City Attorney's Office has reviewed and approved this contract amendment as to form. Upon approval by the City Council, the agreement will be executed by the Director of Public Utilities or designee, who has been delegated this authority by the City Manager. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines (CEQA) Section 15378 the award of this amendment to the design contract does not qualify as a "project" for the purposes of CEQA requirements. LOCAL PREFERENCE Local preference is not implemented because this is an amendment to an existing agreement. FISCAL IMPACT This project is identified in the five year capital improvement plan (Council District 3). Funds in the amount of $5,850,000 for the project were budgeted in the FY2015 Sewer Enterprise Fund No. 40501 for design and construction.
