Dakota Avenue (Council District 4) ..Body RECOMMENDATION It is recommended the Council adopt the attached resolution dedicating certain City-owned property as an easement for public street purposes. EXECUTIVE SUMMARY The City of Fresno Water Division is developing Pump Station No. 52A on the east side of North Ninth Street south of East Dakota Avenue in accordance with Conditional Use Permit No. C-12-176. The Conditions of Approval stipulate that an easement be dedicated for public street purposes across part of the frontage of the site along North Ninth Street. The dedication of this easement requires City Council approval. BACKGROUND The City of Fresno owns property at 3758 North Ninth Street, located on the on the east side of North Ninth Street south of East Dakota Avenue (APN 437-090-15T). The property for Pump Station No. 52A was acquired by the City of Fresno by a Grant Deed recorded March 22, 2012 as Document No. 2012-0041078, Official Records of Fresno County. The property is being developed by the City of Fresno's Water Division as Pump Station No. 52A in accordance with Conditional Use Permit No. C-12-176. In order to satisfy the requirements of Conditional Use Permit No. C-12-176, it is necessary to dedicate an easement for public street purposes as described in Exhibit "A" and shown on Exhibit "B of the attached resolution. Public Works has approved the legal description of the subject easement. The City Attorney's Office has reviewed and approved the attached resolution as to form. ENVIRONMENTAL FINDINGS An initial study and environmental assessment was prepared for the construction of PS 52A. Mitigated Negative Declaration EA No. C-12-176 was prepared for Conditional Use Permit No. C-12-176, which allowed the construction of PS 52A. It was adopted by the City's Planning and Development Department on October 19, 2012, and a Notice of Determination was filed with the Fresno County Clerk's Office on January 18, 2013. This approval is to implement a portion of the above project. An analysis has been performed pursuant to CEQA Guidelines � 15162 to determine whether subsequent environmental review is required. Based upon this analysis the following findings are made to support the determination that no subsequent environmental review is required: 1. No substantial changes are proposed in the project which will require major revisions of the previous Environmental Assessments due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, there are no changes to the project. 2. No substantial changes occurred with respect to the circumstances under which the project is undertaken which will require major revisions of the previous negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, no substantial changes have occurred. 3. There is no new information, which was not known and could not have been known at the time of the previous Environmental Assessment that the project will have significant effects not discussed in the previous Environmental Assessment. Based upon these findings, it has been determined that no further environmental documentation is required for this approval. LOCAL PREFERENCE Local preference does not apply because the dedication of city-owned property for public purposes does not involve bidding or contracting. FISCAL IMPACT There will be no impact to the City's General Fund because the City's Water Division is funding this Council action. Attachments: Vicinity Map Resolution
