REPORT TO THE CITY COUNCIL October 22, 2015 FROM: BRUCE RUDD, City Manager SUBJECT ..Title RESOLUTION - That requires all future annexations must to be approved by the City prior to the submission to the Local Agency Formation Commission (LAFCo) ..Body RECOMMENDATION Adopt the attached resolution that requires all future annexations must to be approved by the City prior to the submission to the Local Agency Formation Commission (LAFCo). EXECUTIVE SUMMARY The City Council has not adopted a formal resolution requiring all annexations to be approved in scope by the City before being presented to LAFCo for approval. The lack of any formal resolution has resulted, in a few cases, a property owner initiating an annexation on their own. This has resulted in some ambiguity when it comes to the approval of an annexation by LAFCo and the subsequent conditions of these annexations. The adoption of this resolution was also a condition of the recently approved Fire Transition Agreement between the City of Fresno and the Fresno County Fire District. BACKGROUND Pursuant to the recently approved Transition Agreement between the City of Fresno and the County of Fresno Fire District, staff recommends the adoption of a resolution that requires that all future annexations must be approved by the City prior to the submission to the LAFCo. While the vast majority of annexations are submitted by the City of Fresno, there have been occasions in which a developer has initiated an annexation without the City's approval and/or support. In some cases, these annexations have created issues related to requirements of annexations, including the payment of related fees such as the Fire Transition Fee. Furthermore, the General Plan requires the City to adopt policies and requirements that achieved annexations to the City that conform to the General Plan and require a developer to cover all costs related to public infrastructure, services, and facilities. It has been the position of LAFCo that the City needs to adopt a formal resolution making it clear that the City will not support any future property owner initiated annexations. Current procedures require any annexation proposal to undergo a "Prezone" process which requires City Council approval prior to formal submittal to LAFCo. Approval of the proposed resolution will ensure that the City has thoroughly vetted any annexation proposal and would eliminate developer petitioned annexation requests.
