MORRISON, PE, Assistant Director Public Works Department, Engineering Division BY: JASON MILLER, PE, Supervising Professional Engineer Public Works Department, Design Services Section SUBJECT ..Title Approve a second amendment to the Agreement with BKF Engineers in the amount of $17,850, for a total contract amount of $82,920, to provide additional consulting services for the Shields Avenue Bankside Trail from Fresno Street to First Street (Council District 7) ..Body RECOMMENDATION Staff recommends the City Council approve a second amendment to the Consultant Services Agreement, dated March 7, 2016 (Agreement) in the amount of $17,850, for a total contract amount of $82,920, to provide additional consulting services required due to an expanded project scope for the Shields Avenue Bankside Trail from Fresno Street to First Street and authorize the Public Works Director or designee to sign and execute the second amendment to the Agreement on behalf of the City. EXECUTIVE SUMMARY The City of Fresno Department of Public Works received Congestion Mitigation and Air Quality (CMAQ) Lifeline and Measure "C" Local funding to construct a Class I multipurpose trail along the south side of Shields Avenue from Fresno Street to First Street. The City entered into the Agreement with BKF Engineers for the Shields Avenue Bankside Trail from Fresno Street to First Street on March 7, 2016. This second amendment to the Agreement allows the City and BKF Engineers to complete Part 3 of the Agreement (Construction Documents), and move to the bid advertisement and construction contract award portion of the project. BACKGROUND This project is the first phase of a Class I bankside multipurpose trail project along the banks of the Fresno Irrigation District's Herndon Canal and Mill Ditch, which will ultimately provide continuous trail facilities from the intersection of Blackstone Avenue and Shields Avenue to a connection with the Clovis Old Town Trail on Clovis Avenue. In addition to the Class I multipurpose trail improvements, this project proposes concrete curb and gutter, street lighting and landscaping and irrigation along the Shields Avenue frontage and adjoining trail. Construction start is anticipated summer 2021. On February 25, 2016 City Council approved the consulting services agreement with BKF Engineers for the design of the Shields Avenue Bankside Trail from Fresno Street to First Street. The City and BKF later executed the First Amendment on January 24, 2017, in the amount $4,900 for additional design services. This Second Amendment to the Agreement is needed to address unanticipated project requirements, which resulted from negotiations between the City and the Fresno Irrigation District. The cost of the second amendment is $17,850 and will be funded with local Measure "C" trails funding. The City Attorney's Office has reviewed and approved as to form. ENVIRONMENTAL FINDINGS Based upon the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item does not qualify as a "project". LOCAL PREFERENCE Local preference was not implemented based on the conditions of the federal CMAQ grant. FISCAL IMPACT The second amendment to the Agreement would be funded by local Measure "C" funding. This amendment will have no impact to the General Fund. The project is within Council District 7.
