MORRISON, PE, Assistant Director Public Works Department, Engineering Division BY: JOHN HONEY, PE, Professional Engineer Public Works Department, Engineering Division, Project Management SUBJECT ..Title ***RESOLUTION - Adopting the 21st Amendment to the Annual Appropriation Resolution No 2020-159 to appropriate $724,500 for the MLK Center Active Transportation Project, also known as the Transformative Climate Communities Leverage Project Southwest Offsite Improvements (Subject to Mayor's veto) (Requires 5 affirmative votes) (Council District 3) ..Body RECOMMENDATIONS Staff recommends that the City Council adopt the 21st Amendment to the Annual Appropriation Resolution No. 2020-159 to appropriate $724,500 for the MLK Center Active Transportation Project, also known as the Transformative Climate Communities Leverage Project Southwest Offsite Improvements, in the Public Works Department. EXECUTIVE SUMMARY Staff is preparing to initiate the design of the MLK Center Active Transportation Project, which is funded with a federal Congestion Mitigation and Air Quality Improvement (CMAQ) Program grant and local Road Maintenance and Rehabilitation Program (SB-1) funds as the match. The project was awarded the CMAQ grant in 2017. Staff recommends Council adopt the amendment to the AAR in order to provide appropriations in the Public Works FY2021 Capital Budget to sufficiently cover anticipated expenditures for the cost of this project. BACKGROUND Staff is seeking Council approval of the attached AAR amendment which will appropriate funding for the MLK Center Active Transportation Project. The project is fully funded via CMAQ and SB-1 funds for a total project cost of $5,617,500, with $724,500 of appropriations being requested for the current FY2021 budget year. The remaining project cost of $4,893,000 will be included in the proposed FY2022, FY2023, and FY2024 capital improvement budgets. The MLK Active Transportation Project will construct Class I trails, Class II bike lanes, sidewalk, and curb and gutter. Class I trails will be built on the north side of East Jensen Avenue between South Knight Avenue and South Martin Luther King Jr. Boulevard and on the south side of East Church Avenue between South Walnut Avenue and South Martin Luther King Jr. Boulevard. Class II bike lanes will be installed on East Jensen Avenue, East Church Avenue, West Walnut Avenue, and West Martin Luther King Jr. Boulevard. Sidewalk and curb and gutter will occur on the east and west side of South Walnut Avenue and the west side of South Martin Luther King Jr. Boulevard. On October 19, 2017, the City Council approved Resolution No. 2017-288 authorizing the submission of the CMAQ grant application. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a project as defined by the California Environmental Quality Act. LOCAL PREFERENCE Local preference does not apply because this is a budget item. Local preference (if applicable) will be considered at the time of contract award. FISCAL IMPACT This Project will have no fiscal impact to the General Fund. The Project is fully funded by CMAQ grant funds as well as SB-1 funds.
