REPORT TO THE CITY COUNCIL FROM: PACO BALDERRAMA, Chief of Police Police Department BY: PHILLIP COOLEY, Deputy Police Chief Administrative Division BURKE FARRAH, Deputy Police Chief Patrol Division SUBJECT ..Title ***RESOLUTION - Adopt the 569th Amendment to the Master Fee Schedule Resolution No. 80-420 to adjust various fees in the Police Department (Subject to Mayor's Veto) ..Body RECOMMENDATION Staff recommends that Council adopt the 569th Amendment to the Master Fee Schedule Resolution No. 80-420 to 1) adjust the Contract Law Enforcement Services (CLES) salary in accordance with the recently fully executed Fresno Police Officers Association (FPOA) Memorandum of understanding (MOU) from Step "D" to Step "E" in FY22 and FY23 and 2) adjust the Regional Training Center (RTC)/Facilities salary also in accordance with the FPOA MOU. EXECUTIVE SUMMARY The attached resolution to adopt the 569th Amendment to the Master Fee Schedule (MFS) Resolution No. 80-420 address fee changes for the Fresno Police Department Contract Law Enforcement Services (CLES) program and the Regional Training Center (RTC)/Facilities. BACKGROUND The revision of the MFS is being presented to enable adjustments approved by Council to be incorporated into the FY 2023 budget. Revenues for both have been estimated and the details for the proposed fee adjustments are outlined below. Contract Law Enforcement Services (CLES): This program allows the public the opportunity to hire an officer for private events at a special contract rate. This fee increased due to MOU Salary adjustments. MOU changes include Officers and Sergeants being paid at one and one-half times "E" step vs "D" step, and Lieutenants, Captains and Deputy Chiefs being paid at their hourly rate vs a negotiated per-shift rate. Regional Training Center (RTC) Facilities: The RTC program allows the outside first responder agencies the opportunity to use the classrooms, range, emergency vehicle operations course and vehicles for pursuit and PIT training. These fees were last increased in FY 10 and FY 16, but due to FPOA MOU increases in FY 23, the training officer fees have been revised to recover the full cost of the services. Fee Description Current Rates New Rates Increase Training Officer - Straight time (per hour) $53.90 $72.37 $18.47 Training Officer - Overtime (per hour) $56.01 $75.67 $19.66 Training Sergeant - Straight time (per hour) $63.62 $85.90 $22.28 Training Sergeant - Overtime (per hour) $67.52 $91.19 $23.67 ENVIRONMENTAL FINDINGS Pursuant to the definition in CEQA Guidelines Section 15378, this is not a "project." LOCAL PREFERENCE Local preference was not implemented as this amendment to the Master Fee Schedule is does not include a bid or award of a construction or service contract. FISCAL IMPACT It is projected the Department will generate approximately $3,567,200 of CLES Fund revenue in FY23. The FY 22 projected revenue was included during the FY 22 budget build process; however, the retroactive salary increases was not approved until after thereby increasing the expenses thus reducing the fund balance. The revenue for FY23 has been included in the budget. The RTC is projected to generate approximately $1,104,900 of POST Fund revenue in FY23 and this has been included in the department's budget.
