REPORT TO THE CITY COUNCIL FROM: TODD STERMER, City Clerk Office of the City Clerk SUBJECT ..Title ***RESOLUTION - Declaring the results of the Statewide Direct Primary Election held on June 7, 2022. (Subject to Mayor's veto) ..Body RECOMMENDATION It is recommended that City Council adopt the attached Resolution declaring the results of the June 7, 2022, Statewide Direct Primary Election. EXECUTIVE SUMMARY On July 7, 2022, the City Clerk's Office received a certified abstract of the canvass of the results of the Primary Election held on June 7, 2022, from the Fresno County Clerk. A resolution declaring the election results is attached for approval by the City Council as required by Elections Code 15400. BACKGROUND A Direct Primary Election was held on June 7, 2022, to elect people to server four year terms as Councilmembers for Council Districts 1, 3, 5 and 7. The Fresno County Clerk / Registrar of Voters returned a certified Statement of Votes Cast which details the election results as follows: COUNCIL DISTRICT 1 Annalisa Perea won the election for Council District 1 outright with 58.75 percent of the vote. COUNCIL DISTRICT 3 Miguel Arias won the election for Council District 3 outright with 62.26 percent of the vote. COUNCIL DISTRICT 5 Luis Chavez won the election for Council District 5 outright with 55.03 percent of the vote. COUNCIL DISTIRCT 7 Nelson Esparza won the election for Council District 7 outright with 66.08 percent of the vote. Pursuant to California Elections Code section 15400, the City Council, as the governing body, must declare elected, the person having the highest number of votes for each office. Under Section 303 of Article III of the Fresno City Charter, those elected shall take office the first Tuesday following the first Monday in January, which will be January 3, 2023. The ceremonial swearing in will occur during the first City Council meeting in January which is currently scheduled for January 5, 2023. ENVIRONMENTAL FINDINGS By the definition provided in the California Environment Quality Act (CEQA) Guidelines, this item is not a "project" for the purpose of CEQA. LOCAL PREFERENCE Local Preference was not implemented because this action does not include a bid or an award of a City construction contract. FISCAL IMPACT Election costs are funded through the General Fund and have already been budgeted in the Fiscal Year 2022 Budget.
