(Consultant), in the amount of $49,076, increasing the total contract amount to $251,321, to expand the Consultant's scope of services to include engineering design coordination between the City of Fresno's (City) Substation Expansion Project and the Solar Energy Project, which is under a separate contract with the City, at its Fresno-Clovis Regional Wastewater Reclamation Facility (RWRF), and authorize the Capital Projects Director or designee to sign and execute all documents on behalf of the City of Fresno. EXECUTIVE SUMMARY On October 26, 2018, City Council approved the Consultant Services Agreement with Electrical Power Systems, Inc. to provide engineering design services for the City's Substation Expansion at the RWRF (Project). Due to the on-going Solar Energy Project, a project under a separate agreement at the City's RWRF, it is now necessary to expand the Consultant's scope of services to include engineering design to coordinate between the two projects, including coordination with Pacific Gas & Electric (PG&E) to meet protection requirements for its transmission system. Approval of this amendment will ensure adequate, reliable, and redundant power source flexibilities for treatment system operations at the RWRF. Funds for this Amendment are included in the Fiscal Year 2024 budget within the Sewer System Enterprise Fund. BACKGROUND The existing substation at the RWRF was commissioned in 2001 and provides a 70 kV transmission feed from two different PG&E substations. A load study performed in late 2017 concluded that the existing substation is nearing available capacity and will not support the next major plant expansions identified in the 2005 Master Plan Update. To meet these future expansion demands for anticipated increases in plant loading due to residential and commercial growth, this Project adds another 70 kV to the 12 kV transformer, rated at 10 Mega Volt Amp (MVA) including the addition of a high-side circuit switcher and connection to the existing switchgear at the existing substation. On October 26, 2018, the City entered into a Consultant Services Agreement with Electrical Power Systems, Inc., in the amount of $177,003, with a contingency amount of $10,000, for professional engineering services for the design of the Substation Expansion Project at the RWRF. The First Amendment to the Agreement dated December 18, 2020, in the amount of $5,000, increased the total contract amount to $182,003, with a remaining contingency of $5,000, to expand the scope of work to include engineering services related to the City's Solar Energy Project at the RWRF. The additional scope of work included review of the Solar Energy Project drawings as related to the Substation Expansion Project. The Second Amendment to the Agreement dated June 10, 2022, expanded the design services to include work related to the electrical intertie between the Substation Expansion Project and the Solar Energy Project at the RWRF. The Second Amendment fully utilized the remaining contract contingency of $5,000 and increased the compensation by an additional $15,242, for a total contract amount of $202,245. The expanded scope provides a coordinated design between the Substation Expansion Project and the Solar Energy Project and will ensure adequate, reliable, and redundant power options for uninterrupted treatment system operations. Staff now recommends approval of the Third Amendment to the Consultant Services Agreement in the amount of $49,076, increasing the total contract amount to $251,321, to expand the scope of services to include work related to providing protection to PG&E's transmission system, engineering to replace the battery system used for the protective control power for the substation, support services during the installation of protective relays for the new PG&E alternate feed location, coordination with PG&E on the required load testing and relay of setting and commissioning, and authorize the Capital Projects Director or designee to execute the Third Amendment to the original agreement on behalf of the City. The City Attorney's Office has reviewed and approved the proposed amendment as to form. ENVIRONMENTAL FINDINGS Contract amendment does not qualify as a project pursuant to California Environmental Quality Act (CEQA) Guidelines � 15378. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to an existing consultant services agreement. FISCAL IMPACT There is no impact to the General Fund. Funds for this Amendment are included in the Fiscal Year 2024 budget within the Sewer System Enterprise Fund. The Project is located in Council District 3.
