RECOMMENDATION
Staff recommends City Council approve Phase One of a Progressive Design-Build Contract (Contract) with Swinerton Builders of Fresno, California, in an amount not to exceed $601,521.00, for the design support services for preparation of construction documents for the Parking Garage Automation and Video Surveillance Project and authorize the Capital Projects Director or designee to execute a final Contract on behalf of the City of Fresno.
EXECUTIVE SUMMARY
In May 2023, City Council approved the use of a Progressive Design-Build project delivery method for the Parking Garage Automation and Video Surveillance Project. Staff issued a Request for Qualifications (RFQ) to develop the Project and received two responsive and responsible Statements of Qualifications (SOQ). Based on the evaluation completed by a selections panel, staff recommends approving a Progressive Design-Build Contract with Swinerton Builders for the design of the parking automation and video surveillance improvements at six existing parking facilities located within downtown Fresno.
The Capital Projects Department and Swinerton Builders shall work collaboratively along with all stakeholders, to design the Parking Garage Automation and Video Surveillance Project in accordance with the Project's scope and budget. The Project's delivery method takes advantage of the design-builder's expertise during all stages of design, funding, and construction, and provides a high degree of cost and schedule certainty. Council approval of Phase 1 of a Progressive Design-Build Contract is required in order for the design of the Parking Garage Automation and Video Surveillance Project to commence. The Progressive Design-Build Contract is funded through fiscal year (FY) 2024 appropriated General Funds.
BACKGROUND
Upon Council approval of the Progressive Design-Build delivery method for the Project, the Planning and Development Department sought to procure a design consultant for the parking automation and video surveillance improvements at the following parking facilities: The Convention Center Garage, Convention Center Surface Lot, Congo Alley Garage, Underground Garage, Spiral Garage and Merced Garage, all located within downtown Fresno. Planned future actions associated with the Parking Garage Automation and Video Surveillance Project include executing Phase Two (construction) of the Progressive Design-Build Contract.
Through a competitive Progressive Design-Build procurement process, the Capital Projects Department advertised a RFQ on February 16, 2024, via Planet Bids and direct email to prospective design-build teams with the capability and experience necessary to execute a Progressive Design-Build Parking Automation and Video Surveillance Project. Two design-build teams responded to the RFQ. Their qualifications were evaluated and rated by a committee of five. The evaluation committee consisted of staff representing different City departments, including Capital Projects, Planning and Development, Information Services, and General Services. Swinerton Builders was determined the only consultant to fully meet the provisions and requirements of the RFQ and an interview was conducted. Swinerton Builders, based in Fresno, CA, and their team, including Walker Consultants, was determined to be the most qualified team to collaboratively work with the City and provide the best opportunity to meet the Project goals and required outcome. The Progressive Design Build Contract utilizes a modified Design-Build Institute of American (DBIA) standard Progressive Design-Build Agreement.
Staff recommend City Council approve the proposed Progressive Design-Build Contract with Swinerton Builders Inc., in an amount not to exceed $601,521, for the design support services for preparation of construction documents for the Parking Garage Automation and Video Surveillance Project and authorize the Capital Projects Director or designee to execute a final contract on behalf of the City of Fresno.
The City Attorney's Office has reviewed and approved the Progressive Design-Build Contract as to form.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this is not a "project' as defined by CEQA.
LOCAL PREFERENCE
Swinerton Builders Inc., is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The proposed project is in Council District 3. The Progressive Design-Build Contract is funded through FY2024 appropriations from the General Fund.
