RESOLUTION - Ordering the summary vacation of a portion of North Broadway Street, South of East Elizabeth Street. ..Body RECOMMENDATIONS Staff recommends the Council adopt a resolution ordering the summary vacation of a portion of North Broadway Street, South of East Elizabeth Street, as described in Exhibit "A" and as shown on Exhibit "B" of the attached resolution. EXECUTIVE SUMMARY The City of Fresno Public Works Department is requesting the vacation of a portion of North Broadway Street, South of East Elizabeth Street. The purpose of the vacation is to accommodate the Broadway Parque (formerly known as South Tower Park) Project. BACKGROUND The proposed vacation is needed to vacate the public street easement, originally dedicated by City of Fresno with Resolution No. 1777, that is no longer needed. Once vacated by the City of Fresno, the land will be used to accommodate the Broadway Parque (formerly known as South Tower Park) Project and create a new pocket park. The size of the park is approximately 29,000 square feet including the sidewalk and park strips. The Public Works Department, other City Departments and utility agencies have reviewed this proposal and determined that the street right-of-way proposed for vacation is unnecessary for present or prospective public street purposes. The provisions of Chapter 4, commencing with Section 8330 of the California Streets and Highways Code, authorize the Council to summarily vacate the public street easement that is considered excess right-of-way, is not required for street or highway purposes, and has no public utility facilities within the area to be vacated. Under these provisions, only one Council action is necessary and a published notice, posting and public hearing are not required. The City Attorney's Office has approved the attached resolution as to form. The vacation, if approved by the Council, will become effective when the vacating resolution is recorded in the office of the Fresno County Recorder. ENVIRONMENTAL FINDINGS On May 2, 2024, Council adopted the finding of a Categorical Exemption pursuant to Sections 15332/Class 32 and 15304/Class 4 of the California Environmental Quality Act (CEQA) Guidelines. LOCAL PREFERENCE Local preference does not apply because the vacation of public right-of-way does not involve bidding or contracting. FISCAL IMPACT This project is located in District 3 and will be funded utilizing Measure P, Expenditure Category 2 funds appropriated to the Broadway Parque (formerly known as South Tower Park) Project via the FY24 Annual Appropriations Resolution.
