(Subject to Mayor's Veto) ..Body RECOMMENDATION It is recommended that Council adopt the Thirteenth Amendment to the Fiscal Year 2026 Salary Resolution No. 2025-177 to add the new classification of Building Standards Appeals Board Member and the respective stipend, effective October 16, 2025. EXECUTIVE SUMMARY The Planning and Development Department, Building and Safety Division, has a need for a Building Standards Appeals Board Member classification due to the creation of the Building Standards Appeals Board (BSAB). The BSAB will hear and decide appeals of orders, decisions, and determinations made by the City of Fresno related to the Building Code. For the members to be paid, the Fresno Municipal Code requires that the stipend be authorized in the Salary Resolution. The Building Standards Appeals Board Member classification will be placed in Exhibit 12, Unit 12, Board and Commission Members, with a respective stipend of $100 Per Meeting Attended, not to exceed $200 per month. This action will not require additional appropriations. BACKGROUND A resolution creating the BSAB was adopted by Council on May 22, 2025 to comply with Section 1.8.8.1 of the California Building Code. The BSAB will hear and decide appeals of orders, decisions, and determinations made by the City of Fresno related to the Building Code, including violations related to FMC Chapter 11, Article 3 and Article 4. On October 16, 2025, five (5) members were appointed by Mayor Jerry Dyer and approved by Council. This action will add the Building Standards Appeals Board Member title and stipend to the Salary Resolution in order for members to be paid. The City Attorney's Office has approved the Thirteenth Amendment to Salary Resolution No. 2025-177 as to form. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines (CEQA) Section 15378, this item does not qualify as a "project" and is therefore exempt from CEQA. LOCAL PREFERENCE Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno. FISCAL IMPACT The amendment will not require any additional appropriations for Fiscal Year 2026.
