Authorize the Chief of Police to enter into a License Agreement with the Fresno County Sheriff's Office, effective July 1, 2025, to continue to co-locate the Fresno Police Department and Fresno County Sheriff's Office convicted sexual offender registration programs, through a shared use of facility agreement, located in the South Annex Jail at 2280 Fresno Street, in the amount not to exceed $20,000 annually, with an initial term of three years and the option for two one-year extensions ..Body RECOMMENDATION Staff recommends Council adopt a categorical exemption pursuant to Section 15301/Class 1(Existing Facilities) and authorize the Chief of Police to enter into a License Agreement with the Fresno County Sheriff's Office, effective July 1, 2025, to continue to co-locate the Fresno Police Department and FSO convicted sexual offender registration programs, through a shared use of facility agreement, in office space located in the South Annex Jail at 2280 Fresno Street. EXECUTIVE SUMMARY Since 2010, the Fresno Police Department (FPD) has shared office space with the Fresno County's Sherriff Office (FSO) at the Fresno County Satellite Jail, located at 110 M Street, to co-locate the identification, registration, and monitoring of convicted individuals regulated under the provisions of California Penal Code Section 290 (Sex Crimes Registrations). The current Agreement for this office space expired June 30, 2025, and FPD seeks to continue the agreement for three years plus two one-year options at a new location. The new location will be shared office space in the South Annex Jail located at 2280 Fresno Street. The City can terminate the Agreement with or without cause by giving written notice to the County at least thirty days in advance of the effective date of such termination. BACKGROUND Pursuant to State law, persons convicted of specific sex offenses, once on parole, must register with city or county law enforcement agencies where they reside. The law requires annual registration for most sex offender registrants. However, transients without a fixed residence must register monthly. Registration includes filling out required Department of Justice residency information and the updating of photographs and fingerprints for newly released sex offender registrants. The City of Fresno currently has nearly 2,500 registrants. Council approved the prior License Agreement on June 11, 2020, for a five-year term with an annual cost of $20,000 ending June 30, 2025. This Agreement would continue FPD's use of shared office space, except at a new location, from July 1, 2025, through June 30, 2028, with the option to exercise two consecutive, one-year extensions through 2030. The new location will be shared office space in the South Annex Jail located at 2280 Fresno Street. The City's cost for use of the facility will remain at $20,000 annually, which includes all operational expenses. The City can terminate the Agreement with or without cause by giving written notice to the County at lease thirty days in advance of the effective date of such termination. The City Attorney has approved the License Agreement as to form. ENVIRONMENTAL FINDING This Agreement is exempt under Section 15301 (Class 1/Existing Facilities) of the CEQA Guidelines because it involves the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. There is no substantial evidence in the record that any of the exceptions to these Categorical Exemptions, set forth in CEQA Guidelines section 15300.2, apply to this project and no adverse environmental impacts will occur as a result of the proposed project. Accordingly, the Categorical Exemption, as noted above, has been determined to be appropriate. LOCAL PREFERENCE Local preference does not apply as this is not a contract for procurement of materials/goods/ equipment or a professional services agreement. FISCAL IMPACT Funding for this Agreement is included in the Police Department's adopted FY 2026 budget utilizing the General Fund. Attachments: License Agreement with Fresno County Sheriff's Office
