CAMIT, PLS, Chief Surveyor Public Works Department, Engineering Division - Chief Surveyor Section SUBJECT ..Title RESOLUTION - Approving the summary vacation of a portion of the public street easement on Mono Street, southwest of H Street (Council District 3) ..Body RECOMMENDATION Staff recommends the Council adopt a resolution approving the summary vacation of a portion of the public street easement on Mono Street, southwest of H Street, as described in Exhibit "A" and as shown on Exhibit "B" of the attached resolution. EXECUTIVE SUMMARY The Capital Projects Department of the City of Fresno is requesting the vacation of a portion of the public street easement on Mono Street, southwest of H Street, as previously dedicated by Council Resolution 2018-239. The area proposed for vacation is located within the Downtown Core and was originally dedicated to accommodate existing public streets as part of a larger redevelopment effort. The vacation will facilitate the planned development of the H Street Parking Structure Project ("Project"). BACKGROUND The proposed vacation of a portion of the public street easement on Mono Street, southwest of H Street was previously dedicated by Council Resolution 2018-239 to formalize the City's prescriptive right-of-way and ensure adequate public access for existing and future street purposes in the Downtown Core. The area proposed for vacation is located within the Downtown Community Plan Area and the Fulton Corridor Specific Plan. The purpose of this vacation is to accommodate the construction of the Project. No additional funding is required for the summary vacation action; as it is an administrative process that does not involve new construction or acquisition. The Public Works Department, other City Departments, and utility agencies have reviewed this proposal and determined that the street and pedestrian right-of-way proposed for vacation is unnecessary for present or prospective public purposes. The provisions of Chapter 4, commencing with Section 8330 of the California Streets and Highways Code, authorize the Council to summarily vacate the public street easement that is considered excess right-of-way, is not required for street or highway purposes, and has no public utility facilities within the area to be vacated. Under these provisions, only one Council action is necessary and published notice, posting and public hearing are not required. The City Attorney's Office has approved the attached resolution as to form. The vacation, if approved by the Council, will become effective when the vacating resolution is recorded in the office of the Fresno County Recorder. ENVIRONMENTAL FINDINGS Pursuant to Class 32/Section 15332 of the California Environmental Quality Act (CEQA) Guidelines, and that none of the exceptions to exemptions set forth in Section 15300.2, the City found the Project to be categorically exempt from the requirements of CEQA, The Project and its Categorical Exemption was adopted by the Fresno City Council on May 21, 2026. LOCAL PREFERENCE Local preference does not apply because the vacation of public right-of-way does not involve bidding or contracting. FISCAL IMPACT This Project is located in Council District 3. There will be no City funds involved with this vacation. The Project is funded by the Governor's Office of Business and Economic Development (GO-Biz) FY 26 appropriations. All funds necessary for the acquisition are included in the current fiscal year budget as previously adopted by the City Council.
