RECOMMENDATIONS
Staff recommends that the City Council approve Contract Change Order No. 2 with Avison Construction, Inc. of Madera, California in the amount of $405,600.80 and time extension of fifty-nine (59) calendar days for the Blackstone Smart Mobility Project from State Route 180 to Pine Avenue Project and authorize the Capital Project Director to sign the Contract Change Order No. 2 on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The Southern Blackstone Avenue Smart Mobility Strategy, accepted by City Council via Resolution No. 2019-092 on May 2, 2019, is a community-driven vision to improve the Blackstone Avenue/Abby Street Corridor through multimodal transportation and streetscape improvements between Dakota Avenue and Highway 180. The Project implements the Strategy from State Route 180 to Pine Avenue, incorporating a road diet, Class IV protected bikeways, ADA-compliant curb ramps, elevated BRT platforms, landscaping, and pedestrian-scale lighting. On February 26, 2026, the City Council awarded the construction contract to Avison Construction, Inc. of Madera, California, for $5,008,997.00, with a Notice to Proceed issued June 8, 2026. On August 13, 2026, the City Council approved Contract Change Order No. 1 for $951,860.00 to procure pedestrian-scale and street lighting materials.
Staff requests City Council approval of Contract Change Order No. 2 in the amount of $405,600.80 and 59 additional calendar days, approximately 10.8% of the original contract amount, triggering approval thresholds under Resolution No. 2017-158. The change order addresses revised construction documents, an accelerated completion deadline of October 31, 2026, to meet grant reimbursement requirements, and a contract time extension to December 3, 2026, solely to accommodate long-lead lighting material deliveries. If approved, the revised contract total will be $6,503,083.82 over 179 total calendar days. Staff recommends the City Council authorize the Capital Projects Director, or designee, to sign Contract Change Order No. 2 on behalf of the City of Fresno.
BACKGROUND
The Southern Blackstone Avenue Smart Mobility Strategy (Strategy) is a community-driven vision to improve the Blackstone Avenue/Abby Street Corridor, providing recommendations for near-term and long-term multimodal transportation and streetscape improvements to improve safety and comfort conditions for pedestrians, bicyclists, transit riders, and drivers. The Strategy's study area is located on Blackstone Avenue extending from Dakota Avenue to Highway 180. On May 2, 2019, the City Council accepted the Strategy by Resolution No. 2019-092.
The Project implements the Strategy along the Blackstone Avenue/Abby Street Corridor from State Route 180 to Pine Avenue and includes a road diet on Blackstone Avenue and Abby Street, construction of Class IV protected bikeways with raised median islands, sidewalks, Americans with Disabilities Act (ADA)-compliant curb ramps, elevated Bus Rapid Transit (BRT) platforms, landscaping, and pedestrian-scale lighting.
On February 26, 2026, the City Council awarded the construction contract for the Project to Avison Construction, Inc. of Madera, California (Contractor) in the amount of $5,008,997.00, as the lowest responsive and responsible bidder. The Contractor's Notice to Proceed was issued with a start date of June 8, 2026. On August 13, 2026, City Council approved Contract Change Order No. 1 in the amount of $951,860.00 to allow the Contractor to furnish and procure the pedestrian and streetlight materials required for the Project.
Contract Change Order No. 2 (CCO No. 2) for the Project addresses three distinct categories of change: construction cost adjustments resulting from revised construction documents that include scope changes, acceleration of construction to meet grant funding deadlines, and additional contract time to accommodate long-lead material deliveries, further explained as follows:
Construction Document Revisions. Revisions to the construction documents introduced several scope changes to the Project, including reduced roadway excavation quantities, revised pedestrian lighting, traffic signal modifications, and updated striping and signage. CCO No. 2 also incorporates design revisions at the intersection of N. Blackstone Avenue and E. Olive Avenue, consisting of a modified concrete drive approach, elevation corrections, removal of curb and gutter, additional hot mix asphalt (HMA), and electrical conduit rerouting.
Accelerated Completion Requirement. To maintain project momentum and reach a substantial completion by the end of October, allowing adequate time for the City to prepare a recapitalization, pay the invoice, and submit a reimbursement request to the grant, CCO No. 2 requires the Contractor to complete all construction work identified in the revised project schedule submitted to the Capital Projects Department on October 1, 2026, on or before October 31, 2026. This requirement is expressly stated in the change order. To meet this accelerated deadline, the Contractor is authorized to utilize extended work hours or concurrent operations. CCO No. 2 also establishes a formal procurement contingency plan to address any material availability issues that may arise.
Contract Time Extension for Long-Lead Materials. The pedestrian-scale lighting and street lighting materials added to the contract through Contract Change Order No. 1 are long-lead items whose procurement timelines are outside the Contractor's control. Recognizing this, CCO No. 2 includes fifty-nine (59) additional calendar days, extending the total contract time to December 3, 2026, solely to allow sufficient time for the receipt and installation of these materials. Notwithstanding this overall contract time extension, the Contractor remains obligated, as a condition of CCO No. 2, to complete all other work in accordance with the October 1, 2026 revised project schedule on or before October 31, 2026.
City Council approval of Contract Change Order No. 2 is required by Resolution No. 2017-158, which establishes approval thresholds for individual contract change orders that exceed 1% of the total contract price or $100,000, whichever is greater; aggregate contract change orders that exceed 10% of the original contract amount; and contract time extensions that, by themselves or aggregated with previous time increases, equal or exceed thirty (30) days or 20% of the total contract time allowed under the contract, whichever is greater. The amount of Contract Change Order No. 2 is $405,600.80 and fifty-nine (59) additional calendar days, which is approximately 10.8% of the original contract amount. This increase will result in a revised contract total of $6,503,083.82 and 179 total calendar days. Contract Change Orders are summarized in the table below.
