REPORT TO THE CITY COUNCIL June 2, 2016 FROM: DOUGLAS SLOAN, City Attorney City Attorney's Office SUBJECT ..Title RESOLUTION - Adopting Administrative Order 2-16 to be applicable to elected and appointed officials ..Body RECOMMENDATION It is recommended Council approve the Resolution that would make Administrative Order 2-16 applicable to City elected and appointed officials. EXECUTIVE SUMMARY The proposed Resolution would make AO 2-16 applicable to all City elected and appointed officials who are not otherwise covered by the AO. The AO addresses discrimination and harassment, and the procedures for reporting and investigating claims. BACKGROUND Proposed Assembly Bill (AB) 1661 mandates sexual harassment training for all public elected officials. Additionally, the Personnel Department is working on updating the AO to simplify it and address a number of recent changes in state regulatory law effective April 1, 2016. While preparing these changes and in light of AB 1661, it became apparent the City lacks a policy and procedure for handling these types of matters, so the proposed Resolution would provide the appropriate policy and procedures. ENVIRONMENTAL FINDINGS This is not a project for CEQA purposes. LOCAL PREFERENCE This is not a contract subject to local preference. FISCAL IMPACT Negligible. Attachment: Resolution
