EXECUTIVE SUMMARY The City of Fresno seeks to widen the westbound portion of Herndon Avenue from Brawley Avenue to Blythe Avenue. The City and Fresno County Transportation Authority (FCTA) have executed the Measure "C" Cooperative Project Agreement (Urban 5KC) authorizing regional Measure "C" funds for the Right-of Way phase of this project. Staff now seeks Council approval of additional Measure "C" funds for the Construction Phase. BACKGROUND The City of Fresno seeks to widen the westbound portion of Herndon Avenue from Brawley Avenue to Blythe Avenue. Eastbound Herndon Avenue was previously widened as a separate project. The westbound widening project will bring this segment of Herndon Avenue into conformance with the 6-lane expressway designation, thereby relieving traffic congestion and delays. The project scope also includes the permanent median island completion and extension of the Class 1 multi-purpose trail along the north side of Herndon Avenue within the project limits. On December 10, 2014, the City and FCTA executed the Measure "C" Cooperative Project Agreement (Urban 5KC) which designates $26,000 of Measure "C" funds for the Preliminary Engineering and Right-of-Way phases of the project. The cooperative agreement, along with Federal Regional Surface Transportation Program (RSTP) dollars provide the entire project funding for these two phases. Approval of the attached amendment to the cooperative agreement will reallocate $3,000 from Right of Way phase to the Construction phase and allocate $79,000 of Construction funding, for a total of $82,000 of Construction funding. Staff will return to Council at a later date for the adoption of the associated CEQA document and approval of Right-of-Way acquisition agreements. Staff recommends Council approve Amendment No. 1 to the Measure "C" Cooperative Project Agreement for the Herndon Avenue Westbound Widening from Brawley Avenue to Blythe Avenue (Urban Project K5C). The City Attorney's Office has reviewed and approved the proposed agreement as to form. ENVIRONMENTAL FINDINGS By the definition provided by the California Environmental Quality Act Guideline (CEQA) Section 15378, this item does not qualify as a "project" for the purpose of the CEQA. LOCAL PREFERENCE Local preference was not implemented because a cooperative agreement does not include a competitive bid. FISCAL IMPACT Completion of this $1.1 million project in District 2 will have no impact upon the City's General Fund. The project will be fully funded by Regional Measure "C" Tier 1 funds, Federal RSTP funding and Citywide Regional Street Impact Fees.
