Authorize the Director of Public Utilities, or designee, to sign all documents on behalf of the City of Fresno. EXECUTIVE SUMMARY The Department of Public Utilities seeks Council approval for a First Amendment to the Professional Consultant Services agreement with The Sol�s Group to perform labor compliance monitoring services during the construction of the City of Fresno's 80-million gallon per day Southeast Surface Water Treatment Facility (Facility). Construction of the Facility began in December 2015. It has been determined that the City would like to increase the Consultant's scope to include services to analyze and document Facility construction workforce data. The City and Consultant have agreed to a value for the additional services in the amount of $48,230. BACKGROUND The Water Division has developed the City's Metropolitan Water Resources Management Plan (Plan). The Plan is comprised of multiple capital projects to provide a sustainable and reliable water supply for the community; repair, and replace aging infrastructure; and eliminate the over drafting of the City's groundwater resources. A major component of the plan is to construct the Facility. Construction of the Facility has begun in December 2015, and is scheduled for completion in August 2018. Construction of the Facility requires labor compliance monitoring services to assure that construction contractors comply with state and federal labor law. This includes review and validation of labor compliance reporting documentation for more than 250 workers. The Department of Public Utilities has contracted with The Solis Group to provide the required labor compliance monitoring services for the Facility project, for a not to exceed fee of $137,750, including $5,000 of optional services budget. This work is underway and expected to be completed within budget. Upon further considering needs related to analysis, understanding and documentation of workforce characteristics, staff have requested that the Consultant provide additional services to analyze Facility construction workforce data and document the amount of work performed by local residents and union-affiliated workers. Staff has negotiated an increase in compensation for these additional services in the amount of $48,230, paid on a time and materials basis in conformance with requirements of the original agreement. Upon approval by the City Council, the First Amendment to Agreement will be executed by the Director of Public Utilities or designee, who has been delegated this authority by the City Manager. This First Amendment has been approved as to form by the City Attorney's Office. ENVIRONMENTAL FINDINGS Approval of the consultant service agreement amendment is not a "project" within the meaning of Public Resources Code Section 21803 (CEQA Guidelines � 15378) because the organizational and administrative activities as identified in the consultant agreement will not result in direct or indirect physical changes in the environment. LOCAL PREFERENCE Local Preference was not implemented because this action does not include a bid or an award of a City construction or services contract. FISCAL IMPACT Approval of this amendment to the consultant services agreement will not impact the General Fund. Funding for this project is included in the Water Division's FY 2017 Capital Improvement Program Budget within the State Revolving Fund Facility D15-02012 Loan Fund (40188).
