EXECUTIVE SUMMARY
On October 20, 2016, staff recommended to the Council that they adopt a resolution certifying the to the Fresno County Auditor the amount of cancellation valuation fee for the cancellation of Agricultural Land Conservation (Williamson Act) Contract No. AP-1366. This action was, in fact, null and void as the property was still under the jurisdiction of Fresno County at the time. The property was annexed to the City on April 28, 2017. Since the property is now under the jurisdiction of the City of Fresno staff recommends that the City Council re-certify to the Fresno County Auditor the amount of the cancellation valuation fee for the cancellation of Agricultural Land Conservation Contract (ALCC) No. Ap-1366.
BACKGROUND
Historically, the subject property was developed with rural residential uses and at one time a commercial nursery occupied a portion of the site. On October 20, 2016 the City Council approved a Finding of Conformity and a pre-zone from the Fresno County RA-20 (Residential Agricultural, 20 acres) zone district to the City of Fresno RS-5/UGM (Residential Single Family, Medium Density/Urban Growth Management) zone district. The City Council also approved Conditional Use Permit No. C-16-046, to allow for a planned development that includes a 30-lot single family residential subdivision (tentative map to be submitted at a later date) and a 176-unit multiple family residential complex with a density transfer, subject to the conditions of approval dated September 21, 2016. Approval of the attached resolution will allow the project to move forward.
ENVIRONMENTAL FINDINGS
An analysis has been performed pursuant CEQA Guidelines � 15162 to determine whether subsequent environmental review is required. Based upon this analysis the following findings are made to support the determination that no subsequent environmental review is required:
1. No substantial changes are proposed in the project which will require major revisions of the previous negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects.
2. No substantial changes occur with respect to the circumstances under which the project is undertaken, which will require major revisions of the previous Finding of Conformity due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, the proposed cancelation was contemplated in the project description and no changes have occurred.
3. There is no new information, which was not known and could not have been known at the time of the previous negative declaration that the project will have significant effect not discussed in the negative declaration.
Based upon these findings, it has been determined that no further environmental documentation is required for this project.
