REPORT TO THE CITY COUNCIL June 8, 2017 FROM: LEE BRAND, Mayor BY: JOHN ELLIS, Government Affairs Manager Office of the Mayor SUBJECT ..Title RESOLUTION - In Support of Assembly Bill 1408. ..Body RECOMMENDATION Mayor Brand recommends the City Council approve the resolution stating its support of Assembly Bill 1408 (AB 1408). EXECUTIVE SUMMARY Assembly Majority Leader Ian Calderon has introduced AB 1408, which would, among other mandates, require revocation of probation if an offender violates probation terms for a third time. Calderon has said his proposed bill is the result of discussions with the law enforcement community and followed the tragic February 20 shooting death of Whittier Police Officer Keith Boyer. This resolution is supported by Fresno Police Chief Jerry Dyer and Fresno County District Attorney Lisa Smittcamp. BACKGROUND In February, Whittier Police Officer Keith Boyer was killed in a shootout with suspect Michael Christopher Mejia, who was on probation when police say he crashed a stolen vehicle and then engaged in a shootout with Boyer and Officer Patrick Hazell. Mejia had been in and out of county jail in the months before the shooting after repeatedly violating the terms of his probation. Under AB 1408, which Calderon introduced in the wake of the shootings, probation revocation would be required if the offender violates probation terms for a third time. In addition, the proposed bill would: * Require the Department of Corrections and Rehabilitation to provide the local law enforcement agency with copies of the record of supervision during any prior period of parole. * Require the panel or Board of Parole Hearings to consider the entire criminal history of the inmate, including all current or past convicted offenses and not just the most recent offense, in making the determination to grant parole. * Require the county agency supervising the release of a person on post-release community supervision to also petition a court to revoke, modify, or terminate post-release community supervision if the person has violated the terms of his or her release for a third time. * Allow a peace officer to arrest a person without warrant who fails to appear at a hearing to revoke, modify or terminate post-release community supervision. The City of Whittier approved a resolution supporting AB 1408, and the city's mayor, Joe Vinatieri, reached out to Mayor Brand seeking support for a similar resolution from the City of Fresno. Mayor Brand has reviewed the legislation, as have Chief Dyer and District Attorney Smittcamp, and all are in agreement that it merits a resolution of support from the City Council. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 this item does not qualify as a "project" as defined by CEQA. LOCAL PREFERENCE Local preference was not implemented because this item does not include an award of a construction or services contract.
