At 9:05 AM, the Board convened into Closed Session and the Hearing on Appeal began. Present on behalf of Appointing Authority was Deputy City Attorney III; Brian Velez, and Fire Department; Fire Chief Billy Alcorn. The appellant was present and represented themselves. Witnesses were sequestered and the reading of Order was waived and moved into the record. At 9:09 AM, the Board took a break and returned at 9:15AM to continue the Hearing on Appeal in closed session. There were no opening statements made at the Hearing and the first witness was called to the stand. Entered into motion was the City's first exhibit (exhibit 1) during the first witness testimony. After the witness testified, they were cross-examined regarding each exhibit. The City entered into motion a total of 4 exhibits which completed all evidence in motion. At 10:22AM the second witness was called to the stand, was sworn in and testified. The second witness was presented with exhibits 1-4. At 10:59AM the witness was crossed examined by the appellant. At 11:06AM the board took a break and returned at 11:13 AM presuming in closed session. The appellant was then placed on the stand to testify and was crossed-examined at 11:30AM. City of Fresno and appellant gave their closing testimony's. The Board convened into executive session to deliberate the matter at 11:51AM. Hearing on Appeal was called back into closed session at 12:25pm. Present for the report of the decision was; The appellant, Deputy City Attorney III; Brian Velez, Fire Chief; Billy Alcorn, Fire Personnel Manager; Ivy Estrada, Board Counsel; James McCann, Acting Secretary Designee; Brittany Blanco, Deputy City Attorney III; Virginia Madrid-Salazar, Deputy City Attorney III; Sylvia Luna. The Board proposed action on motion by Vice Chair Cregar, seconded by Chair McDonald, that the order of removal be upheld. All charges were read and voted on. Charge 1 of violation FMC Section 3-286 (a)(b)(4) as set forth in the order was sustained by the following vote: Aye:4-0 unanimous vote. Charge 2 violation FFD Administrative Manual, 109.011, General Conduct Section 1 as set forth in the order was sustained by the following vote: aye 4-0 unanimous vote. There being no further business to come before the Board, the meeting was adjourned at 12:29PM.- The meeting room is accessible to the physically disabled.
