- Board Counsel James McCann , was present and represented the Board. Also present were Acting Secretary Designee Michael Torosian, Supervising Deputy City Attorney Jennifer DeRuosi , Deputy City Attorney lll Mao Lee, Deputy City Attorney lll Laura Davila and Assistant Director of Personnel Jennifer Misner.

  Present on behalf of the Appointing Authority were: Deputy City Attorney lll Laura Davila and Department of Utilities Director Brock Buche Appellant was self represented. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 2:15 PM, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:44 PM, the Board reconvened into Closed Session and voted on the charges as read by Michael Torosian , Acting Secretary Designee. Present for report of Decision from the Board on behalf of the Appointing Authority were Deputy City Attorney lll Laura Davila and Department of Utilities Director Brock Buche. Appellant was present on his own behalf. Also present were Board Counsel, James McCann , Acting Secretary Designee Michael Torosian.

The motion carried by the following vote: Aye: 3 Board Member Moreno, Board Member Creger and Chairperson McDonald No: 0 The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was Sustained by the following vote: Aye: 3 Board Member Moreno, Board Member Creger and Chairperson McDonald No: 0 The charge of violation of Fresno Municipal Code Section 3-286(b)(7) as set forth in the Order was Sustained by the following vote: Aye: 3 Board Member Moreno, Board Member Creger and Chairperson McDonald No: 0

  23-144Workshop to consider acceptance of the Kings Canyon Corridor Transit-Oriented Development Connectivity Study (Study) and related Environmental Assessment for approximately ±2,880 acres of property located in Southeast Fresno, in an area bounded by East Tulare Avenue to the north, East Butler Avenue to the south, South Argyle Avenue to the east, and Highway 41 to the west. 1. RECOMMEND ADOPTION (to the City Council) of a finding that the project is statutorily exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262 (Feasibility and Planning Studies). 2. RECOMMEND ACCEPTANCE (to the City Council) of the Kings Canyon Transit-Oriented Development Connectivity Study.

Meeting disruption policy

Meetings are conducted so everyone — in the room and watching or calling in remotely — can take part. A person who disrupts a meeting in person may be removed after a warning. Under California SB 707, if a service disruption within the City’s control cuts off the public’s ability to participate remotely, the body takes no further action on agenda items and recesses for at least one hour while staff make a good-faith effort to restore access; the meeting resumes only once remote access is back.
