At 9:08AM the Board convened into Closed Session and the Hearing on Appeal began. Present on behalf of the Appointing Authority were: Senior Deputy City Attorney I, Jennifer DeRuosi and Assistant City Attorney, Erica Camarena Present on behalf of the Appellant were: The Appellant, Attorney at Law, Vismaad Gondara and Labor Representative, Tony Silva. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record.

At 12:04PM, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 1:08 PM, the Board reconvened into Closed Session and voted on the charges as read by Yvonne Teixeira, Acting Secretary Designee. On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the Board uphold the Order of Removal. The motion carried by the following vote: Aye: 4 Chairperson McDonald, Vice Chair Tracy, Board Member Moreno and Board Member Magdaleno The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(3) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(7) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of City Attorney's Office Policies and Procedures as set forth in the Order was sustained with a 4-0 vote. The charge of violation of City Attorney's Office Policies and Procedures, Paragraph 2 - Mission and Culture Statements as set forth in the Order was sustained with a 4-0 vote. The charge of violation of City of Fresno Administrative Order (AO) 2-16 as set forth in the Order was sustained with a 4-0 vote.
