Deputy City Attorney III, Jennifer DeRuosi, and Director of Transportation, Gregory Barfield, were present on behalf of the Appointing Authority. The Appellant was present without representation. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 12:25pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 12:45pm, the Board reconvened into Closed Session and voted on the charges as read by the Acting Secretary Designee, Karnell Grijalva. The charge of violation of the Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained by a 3-0 vote. The charge of violation of the Vehicle Code Section 22100(b) as set forth in the Order was sustained 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 1.(B)(1) as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 1.(C) as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 1.(G) as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 2.(A) 1. as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 2.(C) as set forth in the order was sustained by a 3-0 vote. At 12:50pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act.
